How to Use FGTS to Buy a Property: Complete and Updated Guide

Buying your own home is the dream of millions of Brazilians — and the Fundo de Garantia do Tempo de Serviço (FGTS) can be a powerful ally on that journey. Created in 1966, the fund is formed by monthly deposits made by the employer equivalent to 8% of the employee’s gross salary. Over the years, this balance accumulates and can represent a significant amount, especially for those who have been in the formal job market for a long time.

Using FGTS to purchase properties is one of the most well-known withdrawal modalities — and also one of the most full of details that can catch the worker by surprise. Rules about maximum property value, contribution time, number of withdrawals allowed, and financing modalities need to be understood before any decision. Ignoring these points can result in denial of approval by the bank or even legal problems.

In this article, you will understand how FGTS works for acquiring residential property, what are the requirements, the practical step-by-step, the advantages and limitations of the benefit — all based on current rules and norms published by Caixa Econômica Federal and the FGTS Governing Board.

What is FGTS and how does it work

FGTS is a fund created by the federal government to protect workers dismissed without just cause. Every month, the employer deposits the equivalent of 8% of the employee’s gross salary in a linked account at Caixa Econômica Federal, the fund’s administrator. Domestic workers have the same 8% rate, with specific rules.

The money stays deposited in that account and earns according to rules established by the FGTS Governing Board. Historically, the fund’s profitability is composed of 3% annual interest plus the variation of the TR (Reference Rate), which is usually lower than official inflation (IPCA) in many periods. This is one of the most frequent criticisms of the fund: the balance tends to lose purchasing power over time when compared to other investments.

Precisely for this reason, using FGTS strategically — such as in buying a property — can be an interesting alternative for those who want to give a productive destination to the accumulated balance.

Who can use FGTS to buy a property

Not every worker with a FGTS balance can use it immediately. There is a set of requirements that must be met simultaneously. The conditions below are established by Law No. 8,036/1990 and by resolutions of the FGTS Governing Board:

  • Have at least 3 years of work under the FGTS regime, adding periods from different jobs, consecutive or not
  • Not be the owner of a residential property (paid off or financed) in the municipality where you live or work, nor in municipalities in the metropolitan region
  • Have not used FGTS to buy property in the last 3 years
  • Be a buyer, individually or jointly, with a valid CPF
  • The property must be urban residential
  • The property cannot be intended for commercial or vacation purposes

It is worth noting that the rule of not owning another property applies to the municipality of residence or work of the buyer. This means that someone who lives in São Paulo can, in theory, have a property in another city and still use FGTS — but it is important to confirm this situation with the financing bank, as the analysis is done on a case-by-case basis.

What purposes can FGTS be used for in property purchase

FGTS can be used in three main ways in acquiring residential property:

  1. Full or partial payment of property value — the balance can be used as a down payment or to offset part of the price
  2. Amortization or settlement of outstanding balance in an existing real estate financing
  3. Payment of part of the monthly installments of the financing (in some modalities, with specific conditions)

It is important to understand that FGTS, in this context, is not a “free withdrawal”. The money is transferred directly by Caixa to the construction company, seller, or to offset the financing balance — the worker does not receive the amount in cash.

Property value limit: what the rule says

One point that generates considerable confusion is the property valuation limit for FGTS use. The rules vary according to the housing program and the location.

Under the Minha Casa, Minha Vida, the federal government’s housing program, property value ceilings are defined by ordinances from the Ministry of Cities and can be updated periodically. These limits vary by income bracket and by region of the country (large, medium, and small municipalities have different values).

Outside of Minha Casa, Minha Vida, the use of FGTS in the Housing Finance System (SFH) has a property valuation limit. Always consult Caixa Econômica Federal or the financing bank to verify the ceiling in effect at the time of your operation, as these values are revised frequently and an outdated number can lead to incorrect decisions.

What can be stated with certainty is that high-standard properties, valued above SFH limits, do not allow FGTS use. In these cases, financing occurs through the Real Estate Financing System (SFI), without access to the fund.

Step-by-step: how to use FGTS in practice

If you meet the requirements and want to use your fund balance to buy a property, see how the process works:

  1. Check your FGTS balance through the official “FGTS” app, through the Caixa Econômica Federal website (caixa.gov.br), or at Caixa branches
  2. Verify that you meet all requirements listed above — especially the contribution time and the absence of another property in the same municipality
  3. Choose the property within the valuation limit allowed by SFH or Minha Casa, Minha Vida
  4. Approach a bank or Caixa to make the financing simulation and inform that you want to use FGTS
  5. Provide the necessary documentation, which generally includes:
  • Personal documents (ID, CPF, proof of residence)
  • Work card or FGTS statement
  • Declaration that you do not own property in the municipality
  • Property documentation (title deed, certificates)
  1. Await credit analysis and property appraisal by the bank
  2. Sign the financing contract — FGTS is transferred directly by Caixa for the operation, without going through your checking account
  3. Register the contract at the notary — mandatory step to formalize the purchase

The process can take a few weeks, depending on the financial institution and the complexity of the documentation. Plan ahead.

Advantages and disadvantages: a balanced analysis

Before deciding, it is important to weigh both sides:

Aspect Advantage Disadvantage / Point of Attention
FGTS Returns Using the balance prevents it from continuing to earn below inflation The balance ceases to exist as a labor emergency reserve
Financing Reduction Decreases the financed amount and total interest paid It is not possible to “return” the FGTS if you change your mind
Credit Access Can enable the purchase of a property that would be inaccessible without a down payment Requires meeting a series of simultaneous conditions
Dismissal Protection — By using the balance, you reduce the reserve available in case of dismissal
Amortization Reduces payments and financing term Using for amortization also has rules and minimum terms

An important reflection: using FGTS to buy a property can be a good financial decision for many people, but it is not necessarily the best for everyone. Evaluate whether you have a structured emergency reserve before committing your resources to a long-term purchase. Real estate is a low-liquidity asset — that is, it is not easy to convert to cash quickly if needed.

Important precautions before signing any contract

  • Do not make decisions based solely on informal simulations. Demand the complete financing schedule (CET — Total Effective Cost) from the bank
  • Compare different financial institutions. Caixa is the main operator of mortgage credit, but other banks also operate with FGTS
  • Pay attention to Total Effective Cost (CET): the nominal interest rate is not the only cost of financing. Mandatory insurance, administrative fees, and other charges make up the real cost
  • Check the legal situation of the property before signing any document. A property with pending title issues or property tax debts can stall the transaction
  • Never pay any amount “under the table” before signing the contract registered at the notary

Conclusion: FGTS can be a starting point, not the complete solution

FGTS is a real and concrete tool for those who want to buy a property in Brazil. Used consciously and within the rules, it can significantly reduce the financed amount, decrease the payment term, and make achieving homeownership more accessible.

But it is essential to understand that FGTS is only one part of the financial planning necessary for such an important purchase. Organize your budget, understand your fixed and variable expenses, maintain an emergency reserve, and only then proceed to real estate financing. A well-planned purchase is always safer than a rushed purchase.

Always consult Caixa Econômica Federal, the official FGTS website (fgts.caixa.gov.br), and the financing bank to confirm the rules and limits in effect at the time of your operation, as this information is updated periodically by the FGTS Governing Board.
